USCIS to Allow Premium Processing for EB-1C and EB-2 NIW Petitions

The United States Citizenship and Immigration Services (USCIS) announced that beginning January 30, 2023, the agency will allow US employers to file Form I-907, Request for Premium Processing Service with a filing fee for faster processing of new and pending E13 multinational executive and manager petitions and E21 national interest waiver (NIW) petitions.

US employers that request for premium processing for their Form I-140, Immigrant Petition for Alien Workers or Form I-129, Petition for Nonimmigrant Worker filing are generally guaranteed to receive action on their petition within 15 calendar days. However, Form I-140 petitions filed for E13 and E21 classifications will receive action within 45 calendar days. If no action is made within this time frame, USCIS will refund the premium processing fee and continue with expedited processing.

Later this year, USCIS is expected to make premium processing available for certain F-1 students seeking Optional Practical Training (OPT) and STEM OPT extensions with an initial and pending Form I-765, Application for Employment Application and for certain student and exchange visitors with an initial and pending Form I-539, Application to Extend/Change Nonimmigrant Status.
