48 Month Extension of Green Cards for Conditional Residents with Pending I-751 or I-829

On January 23, 2023, the United States Citizenship and Immigration Services (USCIS) announced that the agency will extend the validity of permanent resident cards (also known as green cards) for individuals that properly filed Form I-751, Petition to Remove Conditions on Residence or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status for 48 months from the card’s expiration date. 

Individuals that recently filed Form I-751 or Form I-829 will receive receipt notices that will state this 48 month extension. Conditional permanent residents that previously received a receipt notice with an extension shorter than 48 months and those that have a case still pending with USCIS will also receive a new, updated receipt notice with this extension. While their application is under review, the new receipt notice with the individual’s expired green card may be presented to show valid lawful permanent resident status and as proof of work and travel authorization for 48 months after the expiration date on your green card.

Conditional residents that plan to be outside of the United States for a year or longer should apply for a reentry permit by filing Form I-131, Application for Travel Document, before leaving the United States.
