On November 10, 2021, the United States Citizenship and Immigration Services (USCIS) agreed to a settlement pertaining to Employment Authorization for spouses of certain nonimmigrants temporarily employed in the United States.
One part of the settlement pertains to nonimmigrants with H-4 status. The settlement grants nonimmigrants with H-4 status an automatic extension of their employment authorization. This automatic extension extends the employment authorization either until the end of their H-4 status or for 180 days after the expiration of their current Employment Authorization, the new expiration will be the earlier date of the two. To obtain the extension, the H-4 status holder must timely file a renewal application of their employment authorization.
Another part of the settlement pertains to nonimmigrants with L-2 status. For nonimmigrants with L-2 status, the settlement provides the spouses with Employment Authorization automatically, without the need to apply for the Employment Authorization Document.
