There are numerous Employment-Based Visas (Green Card). These visas provide opportunities to obtain a green card through your employment. For example, a green card can be obtained through a job offer for permanent employment, an individual with extraordinary abilities, or even though specialized jobs like a religious worker. EB-1: Extraordinary Ability; Outstanding Professors and Researchers; Multinational Managers and Executives
The Employment-Based, First-Preference visa is available for individuals who demonstrate: (A) an extraordinary ability; (B) recognition as an outstanding professor and researcher; or, (C) employment as a multinational manager or executive. EB-1 Visas are preferred since they do not require a Labor Certification. Each occupational category requires certain criteria to be met. In order to qualify, the individual must show an extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. Unlike EB-1B and EB-1C Visas, an EB-1A does not require proof of a permanent job offer.
EB-1B: Outstanding Professors and Researchers
In order to qualify, the individual must demonstrate:
- International recognition for outstanding achievements in a particular field;
- 3 years of experience teaching or researching in the field; AND,
- Entry in the US to pursue tenure, tenure track teaching, or a permanent research position at a university or research institution (proof of an offer of employment from a potential employer).
EB-1C: Multinational Managers and Executives
In order to qualify, the individual must demonstrate that (s)he:
- Was employed by an organization outside of the US for a year in the last 3 years previous to the petition; AND,
- Will be employed as an executive or manager by a qualified organization.
EB-2, EB-3, Labor Certification (PERM), & National Interest Waiver: Persons with Advanced Degrees or Exceptional Abilities; Professionals; Skilled & Unskilled Workers
The Employment-Based, Second-Preference (EB-2) Visa is available for persons with Advanced-Degrees and Exceptional Abilities. The Employment-Based, Third-Preference (EB-3) Visa is available for Professionals, and Skilled and Unskilled Workers. EB-3 Visa requirements are less stringent than the EB-2 Visa; however, the EB-2 Visa allows the visa holders to apply for a green card more quickly. Generally, for EB-2 and EB-3 Visas, (1) the employer must file a Labor Certification, unless a National Interest Waiver applies; (2) the employee must have the employment qualifications as stated in the Labor Certification; and (3) the employer must demonstrate that ability to pay the offered wage. EB-2: Persons with Advanced Degrees
To qualify, the individual must possess at least a master’s degree, a bachelor’s degree with 5 years of progressive experience, or a foreign equivalent.
EB-2: Persons with Exceptional Abilities
The individual must demonstrate a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business field.
The individual must possess a bachelor’s degree, or a foreign equivalent.
The individual must demonstrate that the job requires at least 2 years of job experience or training.
The individual must demonstrate that the job requires less than 2 years of job experience or training.
Unless a National Interest Waiver applies, employers are required to apply for and receive a labor certification from the US Department of Labor. This requires very specific steps that the employer must take, such as identifying the job requirements, a prevailing wage determination, recruitment through advertising, a report of the recruitment results, and the filing of the electronic application on the Program Electronic Review Management (PERM) system.
A National Interest Waiver (NIW) allows the employer to avoid the labor certification process for persons with advanced degrees or exceptional abilities. Persons with advanced degrees and exceptional abilities may also file for a NIW individually and avoid having to find an employer-sponsor. To qualify, the person must meet the EB-2 Visa requirements and must show that their presence will benefit the economical, cultural, or educational interest of the US.
EB-4: Religious Worker
The Employment-Based, Fourth-Preference (EB-4) Visa is available for persons seeking to perform typical religious duties of a religious worker.
In order to qualify, the individual must demonstrate that (s)he:
- was a member of a “religious denomination” for at least 2 years,
- will work at a “qualified religious organization,” and,
- works as a minister, professional or worker in a religious vocation or occupation.
